Acceptance of Terms

By downloading, installing, or using Beanstalk - Child Growth Tracker ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

Description of Service

The App is a mobile application designed to help parents and guardians track their children's growth over time. The App provides:

Height, weight, and head circumference measurement recording and tracking for multiple children
Growth visualization through interactive charts for height, weight, and head circumference
Growth percentile comparisons using WHO and CDC reference data for height, weight, head circumference, and BMI
BMI (Body Mass Index) calculation by pairing height and weight measurements, with age-specific percentiles and category classification
Adult height predictions using growth percentile projection, mid-parental height calculation, and combined methods with confidence levels
Growth velocity analysis with monthly and annual growth rate tracking for height, weight, and head circumference
Growth Insights dashboard with measurement deltas, percentile interpretation, growth milestones, and period comparisons (Pro feature)
Height milestone detection and celebration with animated notifications
AR-based height measurement using device camera, LiDAR, and body pose detection
Interactive avatar that scales with your child's height and fun animal comparisons
Photo timeline, gallery with filtering, and full-screen viewing
Branded share cards for sharing growth milestones on social media
Sibling growth comparison charts for height, weight, and head circumference
PDF growth reports and CSV data export including BMI data
Local backup and restore of all app data (height, weight, head circumference, photos, and preferences)
iCloud Sync for syncing data across devices (Pro feature, optional)
Home Screen widgets (small, medium, and large) for quick growth summaries including BMI
Customizable measurement reminder notifications (weekly, monthly, or quarterly)
Multi-language support (English, Spanish, French, German, Portuguese, and Chinese)

Use of the App

Permitted Use: You may use the App for personal, non-commercial purposes to track height, weight, head circumference, and BMI growth for your children or those in your legal care.

Prohibited Use: You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or modify the App
Use the App to collect data about others without their consent
Redistribute, resell, or sublicense the App
Use the App in any manner that could damage, disable, or impair the App

Medical Disclaimer

The App is not a medical device and is not intended to provide medical advice, diagnosis, or treatment.

Height, weight, head circumference, and BMI growth percentiles and predictions are statistical estimates based on population reference data and the measurements you enter
The App uses WHO and CDC growth reference data for informational and educational purposes only
Growth velocity indicators and trend analysis are approximate and for general interest only
Growth Insights (measurement deltas, percentile interpretation, period comparisons) are derived from your entered data and are for informational purposes only
BMI categories (underweight, healthy weight, overweight, obesity) are based on CDC age-specific reference data and are provided for general awareness only
Head circumference tracking and percentiles are for informational purposes and should not be used to diagnose medical conditions
Weight tracking and percentile information is provided for general awareness only and should not be used to assess nutrition, diagnose conditions, or guide dietary decisions
Always consult qualified healthcare professionals for any medical concerns about your child's growth, weight, head circumference, or development
Do not make medical decisions based solely on information from this App

AR Measurement Disclaimer

The App includes an augmented reality (AR) height measurement feature:

AR measurements are approximate and may vary based on lighting conditions, device position, and environmental factors
AR accuracy depends on device capabilities (LiDAR-equipped devices provide better results)
AR measurements should be verified with a physical measuring tool for accuracy
The developer is not responsible for inaccuracies in AR-based measurements

Accuracy of Predictions

Adult height predictions, growth percentiles, and BMI calculations are statistical estimates based on:

The height, weight, and head circumference measurements you enter into the App
WHO and CDC population reference data
Mathematical algorithms including percentile projection and mid-parental height formulas
Parent height information you optionally provide
BMI pairing of height and weight measurements within a 14-day window

These predictions:

Are not guaranteed to be accurate
Should be considered estimates only
May vary significantly from actual outcomes
Require a minimum of three measurements for calculation
Include confidence indicators to help you assess reliability
Are provided for informational and general interest purposes

Backup and Restore

The App provides a local backup and restore feature for all data (height, weight, head circumference measurements, photos, and preferences):

Backups are your responsibility — the developer does not maintain copies of your data
Restoring from a backup permanently replaces all existing data in the App
The App supports backward-compatible restore from older backup formats
The developer is not responsible for data loss resulting from failed backup or restore operations
You should verify backup integrity before relying on it as your sole copy of data

iCloud Sync

Beanstalk Pro subscribers may enable iCloud Sync to synchronize data across devices:

iCloud Sync requires an active iCloud account and sufficient iCloud storage
Data is synced via Apple's CloudKit infrastructure — the developer does not operate sync servers and has no access to your iCloud data
Sync availability, speed, and reliability depend on Apple's iCloud services and your network connection
The developer is not responsible for data loss, sync conflicts, or delays caused by iCloud service issues
Deleting data on one device will sync the deletion to all connected devices
Disabling iCloud Sync stops new data from being uploaded but does not remove data already stored in iCloud
iCloud Sync is subject to Apple's iCloud Terms of Service

User Responsibilities

You are responsible for:

The accuracy of data you enter into the App
Maintaining the security of your device
Creating backups of your data if you wish to preserve it
Ensuring appropriate and lawful use when tracking children's information
Obtaining consent from other parents or guardians before tracking their children's data

Intellectual Property

The App and its original content, features, and functionality are owned by the developer and are protected by international copyright, trademark, and other intellectual property laws. WHO and CDC growth reference data used in the App is sourced from publicly available datasets.

Data and Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we handle your information.

Key points:

All data (height, weight, head circumference measurements, photos, preferences) is stored locally on your device by default
If you enable iCloud Sync (Pro feature), data is synced via Apple's CloudKit — no third-party servers are involved
You maintain full control of your data at all times
You can export, back up, or delete your data at any time

Limitation of Liability

To the maximum extent permitted by applicable law:

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied
We do not guarantee the App will be error-free, uninterrupted, or free of harmful components
We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App
We are not responsible for data loss due to device failure, loss, theft, or software malfunction
We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement

Indemnification

You agree to indemnify, defend, and hold harmless the developer from any claims, damages, losses, liabilities, or expenses (including reasonable attorney fees) arising from your use of the App or violation of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page. Your continued use of the App after changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

Termination

We reserve the right to terminate or suspend access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

Severability
